WHAT IS REACH & KKDIK?

The harmful effects of chemicals on human health and the environment are known all over the world. For this reason, the most comprehensive legislation on chemicals, the REACH (Registration, Evaluation, Authorization and Restriction of Chemicals) regulation published by the European Union on 1 June 2007.

The REACH regulation published by the European Union covers the supply of substances to the European market, the manufacture of chemicals, their placing on the market or use in mixtures. Obligations such as registration, evaluation, permission, notification and restriction have been introduced.

Following the REACH regulation that entered into force in 2008, KİMYASALLARIN KAYDI, DEĞERLENDİRİLMESİ, İZNİ VE KISITLANMASI HAKKINDA YÖNETMELİK (KKDİK) was published in the Official Gazette dated 23 June 2017 and numbered 30105, by the Ministry of Environment and Urbanization, within the scope of the EU harmonization process. With this regulation, the obligations brought to the EU market will be implemented by adapting them to the Turkish market.

WHO IS COVERED BY REACH REGULATION?

According to the REACH regulation, those who manufacture substances, those who put on the market the products entering the Turkish market, those who use the substance only on its own, in a mixture or in a product, and those who place the mixtures on the market are considered within the scope of this regulation.

WHAT ARE THE ROLES UNDER THE REACH REGULATION?

Within the scope of REACH regulation, there are roles such as importer, manufacturer, downstream user, only representative, 3rd party representative and certain obligations are related to these roles.

WHO HAS A REGISTRATION OBLIGATION UNDER THE REACH REGULATION?

If you are a company that produces or imports more than 1 ton of chemicals within the borders of Turkey, you have the obligation to register these substances through the Chemical Registration System of the Ministry of Environment and Urbanization.

WHAT DATES ARE THE REGISTRATIONS IN?

Chemical records are conducted in two stages. The first stage is the pre-registration process, in which the Pre-SIBs (Substance Information Exchange Form) of the Substances are notified to the Ministry through the Chemical Registration System. The deadline for pre-registration is 31.12.2020. As the second stage, main record file for the registration of the chemicals whose pre-registration is completed, need to be prepared by Person Experts and submitted between 01.01.2021 and 31.12.2021 to the Ministry.

WHAT ARE THE REGISTRATION FEES FOR REGISTRATION OF CHEMICALS?

The unit price list, which states the fees for registration, registration update, demand for information not to be made public, product and process-oriented R&D notifications, was published in early 2021 be the Trading Capital of  the Ministry of Environment and Urbanization. As the permit provisions will come into effect as of 2023, the fees for the permit process will be determined later.
