What Does the EIA Report and EIA Consultancy Services Cover? Is it mandatory?

Rapid population growth, growing industrialization and urbanization cause environmental damage to increase at the same rate all over the world. In this context, many environmental legislations have been implemented and put into practice in our country. One of them is the "ENVIRONMENTAL IMPACT ASSESSMENT REGULATION" published in the Official Gazette on 25 November 2014.

What is Environmental Impact Assessment (EIA)?

ENVIRONMENTAL IMPACT ASSESSMENT (EIA) is the work to be continued in the determination of all the negative environmental effects of the projects planned to be implemented, in the determination and evaluation of the measures to be taken to prevent or minimize them in a way that will not harm the environment, the selected location and technology alternatives, and the monitoring and control of the implementation of the projects.

All parties related to the activities planned in the environmental impact assessment come together to evaluate their opinions and suggestions, and transparent decisions are taken. Before starting the activity, the foreseen problems are tried to be solved, thus preventing cost loss.

Which Businesses Are Evaluated Within the Scope of EIA?

Projects that may have a negative impact on the environment as a result of their activities are determined as "PROJECTS TO BE APPLIED WITH ENVIRONMENTAL IMPACT ASSESSMENT" in Annex-1 list of EIA Regulation and "PROJECTS TO BE APPLIED WITH SELECTION-SCREENING CRITERIA" in Annex-2 list.

EIA Report / Project Introduction File

The report to be prepared in accordance with the Special Format determined by the Ministry for a project that is included in the Annex-1 list or for which the Ministry has decided that "Environmental Impact Assessment is Required" is defined as an EIA REPORT within the scope of the ENVIRONMENTAL IMPACT ASSESSMENT REGULATION.

The file prepared to determine whether it is necessary to apply an EIA to the projects included in the Annex-2 list defined as the Project introduction file in the regulation.

Unless a "Environmental Impact Assessment Positive" decision or a "Environmental Impact Assessment is not Required" decision and an out-of-scope opinion letter for the projects subject to the Environmental Impact Assessment Regulation are received, incentives, approvals, permits, construction and usage licenses for these projects cannot be given, investment cannot be started or tendered for the project.

 

What are the Processes of the Firms That Out of the Scope of the EIA Regulation?

For activities outside the scope of the EIA Regulation, an application is made to the Provincial Directorates of Environment and Urbanization to which they are affiliated, with a petition and necessary documents. As a result of the application, the Provincial Directorate conducts an on-site inspection and confirms the accuracy of the information in the application file. Accordingly, if deemed appropriate, the out-of-scope letter is forwarded to the institution, organization or firm.

Who Prepares the EIA Report and Project Introduction File?

EIA Application File, EIA Report and Project Introduction File can be prepared by institutions/organizations that have been given competency by the Ministry and have a competency certificate.

How Often EIA Report, Project Introduction File, Out of Scope Articles Need to be Updated?

The EIA report, the EIA is not required decision and the out-of-scope opinion letters should be updated under some conditions. The planned capacity increase or expansion of the project, the planned decrease in production capacity, address change, additions and removals in processes, changes in legislation, etc. It is important to update these issues.
